d) Tritt der Charterer vom Chartervertrag zurück (Storno des Mieters), so fallen
Stornierungskosten an:
- bei Rücktritt bis 6 Monate vor Charterbeginn 30 % des Charterpreises,
- bei Rücktritt bis 3 Monate vor Charterbeginn 50 % des Charterpreises,
- bei Rücktritt bis 30 Tage vor Charterbeginn 80 % des Charterpreises,
- bei noch späterem Rücktritt 100 % des Charterpreises, ohne daß ein Schadensnachweis erforderlich ist.
Für Leistungen, die durch den Wegfall der Charter entfallen, werden keine Stornokosten
berechnet, wie z. B. Reinigung, Kautionsabgeltung, Sonderausstattung und dgl.
e) Gelingt eine Ersatzcharter zu gleichen Bedingungen, so erhält der Charterer seine bisher geleisteten Zahlungen abzüglich einer Bearbeitungsgebühr in Höhe von 160.- zurück. Der Charterer kann mit Einverständnis und schriftlicher Zustimmung des Vercharterers einen geeigneten Ersatzmieter stellen, der den Vertrag übernimmt. Bei einer Ersatzcharter zu geringeren Preiskonditionen oder für einen kürzeren Zeitraum bleibt der jeweilige Differenzbetrag zuzüglich der Bearbeitungsgebühr fällig.
f) Es fällt in jedem Fall der Stornierung eine vom Charterer zu leistende Bearbeitungsgebühr von 160,00 an. Die Bearbeitungsgebühr umfasst den verwaltungs- und vermittlungsbedingten Mehraufwand, die der Charterer als Mehrleistung zu vergüten hat, und als weitergehender Schadensersatzanspruch gegenüber dem Charterer begrün
