L’armatore che, per avaria o qualsiasi altro motivo indipendente dalla sua volontà, non possa consegnare la barca contrattata, avrà comunque la possibilità di consegnarne altra di analoghe caratteristiche entro tre giorni, con l’obbligo di rimborsare al locatario la sola quota giornaliera eventualmente non goduta. Qualora il ritardo si protragga oltre il periodo suddetto, sarà facoltà del locatario chiedere la risoluzione del contratto ed il relativo rimborso della tariffa eventualmente corrisposta più gli interessi al tasso di legge, ma senza diritto ad alcun’altra forma di risarcimento.
